Aircraft Litigation

The firm is involved in providing services to people injured and the survivors of people killed in aircraft crashes as well as property damage claims on behalf of aircraft owners. A member of the firm holds a Federal Aviation Administration (FAA) Commercial Pilot Certificate. Another member of the firm is an engineering graduate. Their technical backgrounds combined with the firm's experience in personal injury litigation places the firm in an advantageous position to provide services in this area.

Attorneys fees in death cases and personal injury cases arising out of aircraft operation are handled on a contingent fee basis with the fee being a percentage of the recovery with no fee if there is no recovery. Other aircraft cases such as failure to repair a plane properly may be handled on contingent fee basis or on an hourly basis as agreed in advance between the law firm and the client.

Examples of such litigation include:

  • claims for wrongful death arising out of aircraft crashes from a variety of causes such as pilot error, improper maintenance and aircraft design.
  • claims on behalf of aircraft owners for problems with or damage to aircraft.
  • Death of a pilot and instructor from crash of Cessna 310 during IFR training flight.
  • A suit against an insurance carrier based on failure to pay under its policy for extensive damage to an aircraft resulting from engine failure.
  • A suit against an aircraft manufacturer based on the improper repair of a jet engine resulting in substantial repair expenses and loss of use of corporate jet.
