Mass Torts

Mass torts describes a situation where a number of individuals who have suffered injuries or other damages from a common cause are handled individually but efficiency is gained by representing a number of such clients at the same time. Examples of such litigation may involve products that have caused property damage such as polybutylene piping and products that have caused injuries such as pharmaceuticals.

Such cases are handled on a contingent fee basis with the fee being a percentage of the recovery. There is no fee if there is no recovery.

In a mass tort a large number of plaintiffs join together in bringing individual claims. This is to be contrasted to a class action where a few plaintiffs bring a claim on behalf of a large number of class members.
