Medical Malpractice Action Resulting in Serious Injuries, Including Birth Injuries

Attorneys in the firm are actively involved in representing individuals seriously injured and the survivors of individuals who died as a result of medical negligence in such areas as prenatal care and delivery, surgery, emergency room services, failure to diagnose and improper treatment including incorrect prescriptions. They also provide services in regard to adverse reactions from pharmaceuticals and as to injuries resulting from erroneous medical laboratory tests such as false positive reports leading to serious treatment for non-existing illnesses and false negative tests resulting in a failure to diagnose a serious illness.

Examples of injuries which members of the firm have experience in representing the injured include: brain and other central nervous system injuries, injuries to newborns and mothers arising out of prenatal care, delivery, or post-natal care, injuries arising out of improperly performed or unnecessary surgery, injuries resulting from anesthesia , injuries arising out of improper or delay in diagnosis, and injuries arising out of improper monitoring of patients.

Malpractice cases are handled on a contingent fee basis with the fee being a percentage of the recovery. If there is no recovery, there is no fee.

The firm's practice in this area is limited to cases involving substantial injuries or death. Examples of such litigation include:

  • Severe brain injuries resulting from a prolonged seizure. The allegations of wrongdoing included a failure of the hospital staff to adequately monitor and a failure to adequately respond.
  • Severe brain injuries resulting from the failure to timely diagnose and treat an epidural hematoma.
  • Substantial loss of vision resulting from the failure to properly monitor for adverse reaction to placquenil that was being administered to treat rheumatoid arthritis.
  • Death of a father of two young children where the physicians misdiagnosed his leukemia as being non-Hodgkin's Lymphoma and accordingly provided improper treatment.
  • Death of father of three children where physicians delayed five months in diagnosing that he was suffering from non-Hodgkin's Lymphoma.
  • Several suits involving injuries or death resulting from a failure to timely diagnose and properly respond to a bowel perforation in such circumstances as child delivery, aneurysm repair and adhesion lisation.
  • Severe brain damage during delivery resulting from such circumstances as a failure to recognize and respond to fetal distress as shown on monitor.
  • Improperly performed orthopedic surgeries such as knee replacements.
  • Failure to diagnose injuries such as a fractured acetabulum (hip joint).

If you would like a representative of the firm to call you to discuss a potential medical negligence case, please send an e-mail or phone the office.
