Wrongful Death and Serious Injuries, Including Brain Injuries

Phebus & Koester is actively involved in representing seriously injured individuals and the survivors of individuals who have suffered accidental death. Services are primarily provided in Illinois, however through associating with attorneys in other states, the attorneys in the firm have provided such services in several Midwestern states. Substantial recoveries have been achieved in regard to such matters as motor vehicle wrecks, railroad crossing collisions, defective roadway design or maintenance, defective products such as high pressure vessels, electrical equipment and distribution systems, farm implements and motor vehicles.

These suits are brought to obtain monetary compensation for the losses suffered. Phebus & Koester handle such cases on a contingent fee basis; that is, their fee is a percentage of the recovery. If there is no recovery, then there is no fee.

The term "wrongful death" refers to claims brought by survivors of a person who has died as a result of negligence or other wrongful conduct. The recovery in such suits is for lost financial support and for loss of companionship, friendship, society, love and affection.

Types of injuries which members of the firm have experience in representing the injured include brain and other central nervous system injuries, paralysis, amputation, spinal injuries, severe burns and other catastrophic injuries. In such cases monetary recovery is to compensate for past and future pain, suffering and disability as well as for lost income, lost earnings potential and for past and future medical bills and life care expenses.

  • Suit against Department of Children and Family Services and a foster parent arising out of serious burns suffered by infant while in foster parents' care.
  • Suit against truck line for serious injuries, including numerous broken bones, when truck driver lost control and crossed median of expressway and struck a motorist traveling the opposite direction.
  • Suit against a bus line and a truck line for collision on snow covered interstate resulting in serious injuries to a bus passenger which resulted in, among other things, the fusion of five vertebrae.
  • Death of motorist at intersection where the view of approaching vehicles was obscured by signs.
  • Death of ATV operator who lost control of ATV as a result of suspension system design
  • Death of Motorist at inadequately protected railroad crossing
  • Electrocution of workman on drilling rig when underground high voltage line was struck resulting in serious injuries.
  • Death of operator of ATV when he struck a wire stretched across land adjacent to a roadway.
